Terms Real Estate: Successful bidders will pay an initial earnest money deposit equal to fifteen percent (15%) of the final purchase price. The balance will be due in 30 days at closing. The Sellers, at their option, have the right to extend the closings 30 days if necessary to complete any survey and/or legal work.
Buyers Premium: All real estate sold at this auction will be sold with a 10% buyer’s premium fee. The bid amount plus the buyer’s premium equals the final purchase price. For example: A $10,000.00 bid plus the $1,000.00 buyer’s premium fee equals the final purchase price of $11,000.00.
Inspection: INSPECTION: The property is available for inspection at any time. Tract signs and stakes show the property to be sold. Hudson & Marshall will be available throughout the entire process to show the property by appointment. We strongly encourage you to view the real estate well in advance of the sale.
Closing Cost: The Seller will pay their pro rata share of all 2006 real estate taxes, preparation of the warranty deed and the Georgia transfer tax. The purchaser will be responsible for their pro-rata share of 2006 real estate taxes as well as the closing attorney fees and any other fees associated with closing the transaction, i.e. loan closing costs, appraisal fees, survey fees, title opinions, title insurance, etc.

Comments: FIRST RIGHT OF REFUSAL: Pursuant to the settlement of the estate, one of the heirs has been given a First Right of Refusal on properties #1, 3, 8 and 9. The First Right of Refusal is worded as follows:“Should the Grantor (estate) seek to sell any part of the described tracts and obtain some form of defined offer to purchase or sales contract from a third party, the Grantor (estate) must first submit the offer to the Grantee (heir) who may purchase the specific tract(s) at the same price, terms & conditions, as the third party has sought to purchase. The Grantee (heir) shall have 10 days to accept the offer and forward written notice of same to Grantor. Should Grantee decline offer or fail to submit a response within the ten day period, Grantor (estate) shall be free to convey said specific tract(s) to third party without further claim by the Grantee.” Call Steve Slocumb of Hudson & Marshall with questions.



SURVEY:. The preliminary sales maps have been taken from existing surveys and deeds of record. There are recorded surveys for every parcel being offered (as a whole). If the properties sell as a whole, they will be transferred by existing plats and deeds of records. If any parcel requires additional survey work, Hudson & Marshall has appointed Daniel Riggs Surveying to handle the survey work. All property sold by the acre is sold with an adjustment clause to protect both buyer and seller. The survey expense will be based on a per foot cost and all common line costs will be shared equally. The survey will be an expense of the buyer and due at closing.
